Terms and Conditions of Extended Service Policy for Circuit City Products

"We", "us" and "our" mean ServicePlan, Inc.

"You" and "your" mean customer shown on the sales ticket.

1. Incorporation by Reference.  This Extended Service Contract applies to the products listed on the sales ticket attached to this Extended Service Contract and made a part of this Extended Service Contract (the "Sales Ticket") for which an Extended Service Contract has been purchased.  Any terms and conditions printed on the Sales Ticket are incorporated herein.  As used on the Sales Ticket, "ESP" refers to the purchase of an extended service plan.
 
2. Address of Service Contractor.  We have arranged for service under this contract to be provided by Circuit City Stores, Inc. as service contractor.  The name and address of the service contractor under this contract is the Circuit City Store where the product was purchased or Circuit City Stores, Inc., Extended Service Plan Dept., 9950 Mayland Drive, Richmond, Virginia 23233.
 
3. Coverage.  This contract commences on the "Begins" date as set forth on the Sales Ticket and continues for the period of time indicated on the Sales Ticket.  Subject to the terms and conditions described herein, services performed under this contract shall consist of furnishing labor, parts and components necessary to restore covered products to normal operating condition provided such service is necessitated by product failure during normal, non-commercial use.
 
4. Obtaining Service.  The services provided under this contract are generally available and rendered during the regular working hours of the most convenient Circuit City Service Department or Service Center.  Unless home service is indicated on the Sales Ticket, you must bring the covered product to the nearest Circuit City location.  If you are outside of a service area, it may be necessary for you to ship the covered product to one of our locations, at our expense.
 
 If home service is indicated on the Sales Ticket, repairs will generally be performed at your address.  If some of the work must be done at one of Circuit City's service locations, the transportation of the covered product to and from the service location will be furnished by us.
 
 We will not make any reimbursements or cash outlays for labor or parts, except to Circuit City or companies previously authorized by us to perform services on the covered product.
 
 Retain your contract.  The original customer copy of the contract is your proof of ownership.  You may be required to present your receipt for both the covered product(s) and this service contract.
 
 For information regarding the nearest Circuit City Service Department or Service Center or authorized service location, or to order home service, if applicable, or if you need additional information about obtaining service, you may call the phone number listed on the Sales Ticket.
 
5. Service Limitation.  THIS CONTRACT DOES NOT COVER SERVICE, MAINTENANCE, REPAIR OR REPLACEMENT NECESSITATED BY LOSS OR DAMAGE RESULTING FROM ANY CAUSE OTHER THAN NORMAL USE AND OPERATION OF THE COVERED PRODUCT.  EXCLUSIONS FROM COVERAGE INCLUDE, BUT ARE NOT LIMITED TO, LOSS DUE TO FIRE, WATER, WINDSTORM, HAIL, EARTHQUAKES, RIOT, THEFT, NEGLIGENCE, MISUSE OR ANY OTHER PERIL ORIGINATING OUTSIDE OF THE UNIT.  IN ADDITION, THIS CONTRACT DOES NOT COVER ANY MERCHANDISE (I) USED FOR COMMERCIAL PURPOSES OR (II) REPAIRED BY SOMEONE OTHER THAN AN AUTHORIZED SERVICE TECHNICIAN.  THIS CONTRACT ALSO DOES NOT COVER NON-OPERATING PARTS, SUCH AS BATTERIES, KNOBS, CABINETRY, TRIM PARTS, ANTENNAS, STYLUSES AND OTHER CONSUMABLE ITEMS.  NOTWITHSTANDING THE FOREGOING, THIS CONTRACT DOES COVER SERVICE, MAINTENANCE, REPAIR OR REPLACEMENT NECESSITATED BY LOSS OR DAMAGE RESULTING FROM LOSS OF POWER OR POWER SURGES.
 
6. Preventative Maintenance.  This contract covers annual cleaning and other preventative maintenance required to maintain normal operation of the following products: Video Cassette Recorders, Camcorders, Cassette Players and Portable Cassette Players.  Except as otherwise indicated above, this contract does not cover cleaning or other preventative maintenance required to maintain normal operation of the covered product.
 
7. Replacement Parts.  We will furnish, at no charge to you, replacement of functional parts of any covered product that fail to give satisfactory performance under normal usage, provided such replacements are determined to be necessary by the service contractor in completing services specified in the designated service program.  Replacement parts will be new or rebuilt parts that perform to the factory operational specifications of the product.
 
8. Costs and Fees.  For any covered product, all costs and fees associated with repairs and service, even in-home service, are covered by the purchase price of this contract.
 
9. Cancellation.  You may cancel this service contract for any reason during the first 30 days after it is issued and obtain a full refund of the purchase price by sending written notice (by mail or in person) to the store where the service contract was purchased.  After the first 30 days, you may cancel the service contract by mailing a written notice to Circuit City Stores, Inc., Extended Service Plan Dept., 9950 Mayland Drive, Richmond, VA 23233, to receive a return of the premium based on 90% of unearned premium less any claims that have been paid.  We are entitled to retain 10% of the unearned premium as administrative fee, not to exceed $25.  If we cancel the service contract after the first 30 days, return of premium will be based on 100% of the unearned pro-rata premium.  Informal dispute settlement process is not available under this contract.
 
10.  Transfer of Program.  Your rights under this service contract are transferable with the service contractor's written consent if you provide a prior written request.  The request must include the name and address of the person to whom the service contract is being transferred and it should be sent to the Extended Service Plan Dept. address provided in paragraph 2 above.
 
11. Renewability.  Neither ServicePlan, Inc. nor Circuit City is obligated to renew this contract.  If a renewal contract is offered to you, the renewal price will reflect the age of the covered product and current service costs at the time of renewal.  If you fail to make any payment for a renewal contract, if one is offered, within 15 days of its being due, the offeror may terminate the remaining portion of the renewal contract, without any liability.
 
12. Limitation of Liability.  TO THE EXTENT PERMITTED BY LAW, WE AND CIRCUIT CITY DISCLAIM ANY LIABILITY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES RELATED TO ANY SERVICES PROVIDED UNDER THIS CONTRACT.
 
The obligations of ServicePlan, Inc., under this agreement are insured separately by an insurance policy issued to ServicePlan, Inc., by:
